Terms & Conditions – Lovely Lady (ABHJ Fashions Private Limited)

These Terms & Conditions (“Agreement”) constitute a legally binding agreement between you (“User”, “you”, “your”) and ABHJ Fashions Private Limited, operating under the brand name Lovely Lady (“Company”, “we”, “our”, “us”), governing your access to and use of our website, products, and services.

1. Eligibility

4. Pricing, Taxes & Payment Terms

• All prices are listed in INR and are subject to change without prior notice.
• Prices are inclusive of applicable GST unless stated otherwise.
• The Company reserves the right to correct pricing errors and cancel orders arising from such errors.
• Payments may be processed prior to dispatch.

5. Cancellation & Refund Policy

5.1 Cancellation by User

• Cancellation requests must be made within 24 hours of order placement.
• Orders that are processed, shipped, or dispatched cannot be canceled.

5.2 Cancellation by Company
We reserve the right to cancel orders due to:

• Product unavailability
• Errors in pricing or description
• Suspected fraudulent transactions
• Quality control issues

5.3 Refunds

• Refunds (if applicable) shall be processed only for prepaid orders.
• Refund timelines depend on banking/payment gateways.
• No refunds shall be provided for Cash on Delivery (COD) orders, except where required by applicable law.

6. Returns & Exchange Policy

• Returns/exchanges are accepted only for unused products with tags intact, within 3 days of delivery.
• Products must pass inspection before approval of return/exchange.
• Shipping charges for returns/exchanges may be borne by the customer unless the product is defective.

7. Cash on Delivery (COD)

• COD is available only for selected locations.
• A prepaid amount of ₹200 is required for all COD orders.
• The Company reserves the right to disable COD for any user without prior notice.

8. Delivery, Shipping Charges & Risk of Loss

• Risk of loss and title for products pass to you upon delivery.
• Delivery timelines are estimates and not guaranteed.
• The Company is not liable for delays caused by logistics partners, force majeure events, or incorrect shipping details.
• Shipping charges may apply unless otherwise stated (e.g., free shipping promotions).

9. Intellectual Property Rights

All content on the website, including but not limited to text, images, logos, graphics, design, and software, are the exclusive property of ABHJ Fashions Private Limited (Lovely Lady).
Unauthorized use, reproduction, or distribution is strictly prohibited and may result in legal action.

10. UserGenerated Content

If you post reviews or comments, you agree not to submit content that is defamatory, unlawful, or infringes thirdparty rights.
The Company reserves the right to remove such content at its discretion.

11. Prohibited Uses

You agree not to:

• Engage in fraudulent transactions

Violation may result in immediate termination and legal action.

15. Fraud & Suspension

The Company reserves the right to:

• Cancel orders
• Initiate legal proceedings
in case of suspected fraud or misuse.

16. Electronic Communication

• Whatsapp
• Website notifications

You may opt out of promotional communications at any time.

17. Force Majeure

18. Governing Law & Jurisdiction

Courts located in Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes.

Parties shall first attempt to resolve disputes amicably.
Failing which, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996.
Arbitration shall be conducted by a sole arbitrator appointed by the Company.

20. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Entire Agreement

This Agreement constitutes the entire agreement between you and the Company and supersedes all prior communications.

22. Amendments

We reserve the right to modify these Terms at any time. Continued use of the website constitutes acceptance of revised Terms.

23. Shopify Hosting

Our website is hosted on Shopify Inc., which provides the ecommerce platform.
Your use of the website is also subject to Shopify’s terms of service and data handling practices.
